English translation below.

Dokumentfassung: 1.2
Stand: 13. Oktober 2026
Anbieter: Pulsonics GmbH, Brunnenweg 7, 61352 Bad Homburg, Deutschland. Eingetragen beim Amtsgericht Bad Homburg, HRB 17063. Kontakt: info@pulsonics-emr.com, +49 6172 597310.

Diese deutsche Fassung ist verbindlich.

  • Was Sie erwerben.

Siehe Abschnitt 9.

7. Was Sie nicht tun dürfen

Pulsonics Terms of Use

English translation for convenience; the German text above is binding. See also the app privacy notice.

Document version: 1.2
Last updated: 13 October 2026
Provider: Pulsonics GmbH, Brunnenweg 7, 61352 Bad Homburg, Germany. Registered with the Local Court of Bad Homburg, Commercial Register No. HRB 17063. Contact: info@pulsonics-emr.com, +49 6172 597310.

This is an English translation provided for convenience. The German version of these terms is binding.

1. What these terms cover, and your licence

These terms govern your use of the Pulsonics electronic medical record software ("Pulsonics", "the Software"), whether you use it on iOS, Android or in a web browser.

Pulsonics is sold to an organisation — a practice, clinic or hospital department, called "your organisation" below — and used by the people that organisation authorises. If you are accepting these terms on behalf of an organisation, you confirm that you are authorised to do so and that the organisation is bound by them.

Your licence. For as long as your organisation's access is active, we grant you a non-exclusive, non-transferable, non-sublicensable right to use the Software for your organisation's own professional purposes, within the number of user accounts its subscription covers and in accordance with these terms. The Software, including its source code, design and documentation, remains ours; nothing in these terms transfers any intellectual property to you. Where you obtained the app from the Apple App Store, section 13 also applies.

Language. These terms are issued in German and English. The German version is binding; the English version is a translation provided for convenience. If the two differ, the German version prevails.

2. Pulsonics is not a substitute for clinical judgement

The Software stores, organises and presents clinical information that you and your colleagues enter. It does not practise medicine.

  • Pulsonics is not registered as a medical device. Ensuring that its use complies with the laws, regulations and professional rules applying where you practise is your responsibility and your organisation's.
  • Every clinical decision remains the responsibility of the treating clinician. Nothing the Software displays, calculates, summarises or alerts on removes or reduces that responsibility.
  • Features that draw on external artificial intelligence services produce suggestions, not findings. They must be reviewed by a qualified person before they influence care.
  • The Software is not designed for use as the sole record in an emergency where no alternative is available. Your organisation is responsible for having a fallback when a device, a network or the service is unavailable.

3. Accounts and who may use them

Accounts are personal. Each person who uses Pulsonics needs their own account, and credentials must not be shared — an audit trail that says who saw and changed a patient's record is worthless if two people share a login.

Your organisation is responsible for who it invites, what permissions it grants them, and for removing access promptly when somebody leaves.

You must tell us without delay if you believe an account has been compromised.

4. Subscriptions bought through the App Store or Google Play

Where the Software offers a subscription inside the iOS or Android app, the following applies.

  • What you are buying. A subscription to Pulsonics for a stated maximum number of user accounts in your organisation — for example five, ten or twenty-five users. The number of accounts you may have active at one time is the number your subscription covers.
  • It renews automatically. The subscription is an auto-renewing subscription. It renews for the same period and at the then-current price unless it is cancelled at least 24 hours before the end of the current period.
  • Period and price. The billing period and the price are shown in the app before you confirm, and are the ones the App Store or Google Play states for your country and currency. That price, and not any figure quoted elsewhere, is what your account is charged.
  • Payment is taken by the store, not by us. Payment is charged to your Apple ID or Google Play account at confirmation of purchase, and again on each renewal. We never see or hold your card details.
  • Cancelling. You cancel in the store, not in Pulsonics: on iOS in Settings → your name → Subscriptions, on Android in the Google Play app under Payments and subscriptions → Subscriptions. The app links to that screen. Cancelling stops the next renewal; it does not shorten the period you have already paid for, and you keep access until that period ends.
  • Refunds. Refunds for store purchases are handled by Apple or Google under their own policies. We cannot refund a store purchase ourselves, and we cannot cancel a completed transaction on your behalf.
  • Free trials and introductory offers. Where one is offered, its length and what it becomes are shown before you confirm. An unused portion of a free trial is forfeited when you buy a subscription.
  • Price changes. If the price rises, the stores notify you and ask you to agree before the increase takes effect. If you do not agree, the subscription does not renew.

Subscriptions bought directly from us rather than through a store are governed by the separate agreement signed for them, not by this section.

5. What happens when your organisation exceeds its seats

If your organisation has more active user accounts than its subscription covers — typically after moving to a smaller subscription — it first has a grace period, shown in the app, to reduce the number of active accounts or move to a larger subscription. During the grace period the affected users and all administrators see a notice; nothing else changes.

If the grace period ends without that happening, the accounts beyond the number the subscription covers become read-only: they can still open and read every record they are permitted to see, so that nobody loses sight of a patient, but they cannot enter or change anything. An administrator beyond that number can in addition manage user accounts, so that the organisation can bring itself back within its subscription. Which accounts are beyond the number follows the order in which the accounts were created, beginning with the account that set up the organisation; disabled accounts do not count.

The grace period is available once in any six months, counted from the start of the previous one. A second overage within that time takes effect immediately.

If the subscription lapses altogether, all accounts become read-only until a subscription is in place again.

We never delete patient data because of an overage or a lapsed subscription. See section 9.

6. Your data, and ours

The clinical record belongs to your organisation. Patient data entered into Pulsonics is your organisation's data. Where we process it, we do so on your organisation's instructions and for no purpose of our own: we do not sell it, we do not use it for advertising, and we do not use it to train artificial intelligence models.

In data protection terms, your organisation is the controller of patient data. Where Pulsonics GmbH hosts the data, it is a processor acting on your organisation's behalf; that relationship is governed by our Data Processing Agreement under Article 28 GDPR, which is available in the app, is accepted by your organisation together with these terms, and forms part of the contract. Where your organisation runs Pulsonics in a cloud of its choice or on its own servers (on-premise), we provide only the software and are not a processor of the data stored there. The Privacy Policy describes what is processed, where, and by whom.

For your own account data — your name, your work contact details, your sign-in and audit records — we are the controller, and the Privacy Policy covers that too.

Medical confidentiality. Patient information in Pulsonics may be subject to professional secrecy, in particular under section 203 of the German Criminal Code (StGB). Pulsonics GmbH acts as a contributing person within the meaning of section 203(3) StGB. We keep such information confidential, gain knowledge of it only to the extent strictly necessary to provide the service, and bind every employee and subcontractor involved to confidentiality in writing. The Data Processing Agreement sets this out in detail.

7. What you must not do

  • Use Pulsonics to store information you have no lawful basis to hold.
  • Give access to anybody who is not authorised by your organisation.
  • Attempt to access another organisation's data, or to circumvent the separation between organisations.
  • Reverse engineer, decompile or disassemble the Software, except where that right cannot lawfully be excluded.
  • Use the Software in a way that interferes with its operation for others, or to send unlawful, abusive or misleading content through its messaging.
  • Resell, sublicense or provide the Software to a third party as a service.

8. Availability, support and changes

We work to keep the service available but we do not promise uninterrupted operation. Maintenance, faults and events beyond our control will cause downtime.

We may change the Software, including adding, altering and removing features. Where a change materially reduces what a paid subscription provides, we will give reasonable notice.

Support is provided by Pulsonics GmbH in the manner and to the level agreed with your organisation.

9. Ending the agreement, and getting your data out

You may stop using Pulsonics at any time, and your organisation may cancel its subscription as described in section 4.

We may suspend or end access if these terms are seriously or repeatedly breached, or if we are required to by law. Except where the breach makes it impossible, we will give notice and an opportunity to put things right first.

Your organisation can export its data. On termination, and for a period afterwards stated in the contract or, failing that, for 30 days, your organisation may export its records. Where Pulsonics GmbH hosts the data, we delete or anonymise it after that period in line with the Privacy Policy and the Data Processing Agreement, subject to any retention we are legally required to observe. Medical record retention periods set by the law where you practise are your organisation's responsibility, and are usually far longer than any subscription.

10. Liability

Nothing in these terms excludes liability that cannot lawfully be excluded — in particular liability for injury to life, body or health, for intent or gross negligence, or under the German Product Liability Act.

Subject to that: we are liable for breach of a material contractual obligation only up to the foreseeable damage typical for this kind of contract, and we are not liable for indirect or consequential loss, lost profit, or loss arising from your organisation's failure to keep its own backups or to maintain a fallback for when the service is unavailable.

11. Governing law

These terms are governed by the law of the Federal Republic of Germany, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Where the customer is a merchant, the place of jurisdiction is Bad Homburg.

12. Changes to these terms

We may update these terms. The version and date at the top change when we do. Where an update materially affects your rights, we will ask you to accept the new version in the app before you continue, and we record which version you accepted and when.

13. Additional terms for the Apple App Store

This section applies where you obtained the Pulsonics app ("the App") from the Apple App Store. Where it conflicts with the rest of these terms, this section prevails for your use of the App.

  1. Parties. These terms are concluded between you and Pulsonics GmbH only, and not with Apple Inc. ("Apple"). Pulsonics GmbH, not Apple, is solely responsible for the App and its content.
  2. Scope of licence. The licence in section 1 is, for the App, a non-transferable licence to use it on any Apple-branded products that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
  3. Maintenance and support. Pulsonics GmbH is solely responsible for providing any maintenance and support for the App, as set out in these terms or as required by applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services for the App.
  4. Warranty. Pulsonics GmbH is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively excluded. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are the responsibility of Pulsonics GmbH.
  5. Product claims. Pulsonics GmbH, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation.
  6. Intellectual property. If a third party claims that the App, or your possession and use of it, infringes that third party's intellectual property rights, Pulsonics GmbH, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
  7. Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a United States Government embargo or that has been designated by the United States Government as a "terrorist supporting" country, and are not subject to European Union sanctions; and (ii) you are not listed on any United States Government list of prohibited or restricted parties.
  8. Developer name and address. Questions, complaints and claims about the App should be directed to Pulsonics GmbH at the address in section 14.
  9. Third-party terms. You must comply with any applicable third-party terms when using the App, for example your mobile data service agreement.
  10. Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these terms, and on your acceptance of them Apple has the right, and is deemed to have accepted the right, to enforce these terms against you as a third-party beneficiary.
